⁠TRAC Desktop (Community Edition)

TRAC is model orchestration solution which integrates your data and compute infrastructure, model development environments, and the repository of versioned code, to create a single ecosystem in which to build and deploy models, orchestrate calculations, and run analytics. TRAC Desktop is a single-user desktop implementation of the TRAC platform.

⁠LICENSE FOR TRAC DESKTOP (COMMUNITY EDITION)

This distribution of TRAC Desktop (Community Edition) as a Docker image (the "Image") is copyrighted by FINTRAC LTD and is subject to multiple open-source licenses. The Image consists of:

• Custom Code developed by FINTRAC LTD, licensed under the Apache License, Version 2.0 (the “Apache 2.0 License”), with additional restrictions imposed by the Commons Clause (together, the “License” for the Custom Code).

• Third-party software components, including TRAC D.A.P., which are licensed separately under their respective open-source licenses, including GNU General Public License (GPL), MIT, BSD, and others. These components, including TRAC D.A.P., are subject to their own respective licenses, which are not modified by this License.

The term “License” used herein refers to the combined licensing structure that governs the entire Image, including both the Custom Code (with Apache 2.0 and Commons Clause) and the third-party components (each governed by its own license). Where applicable, the Commons Clause modifies the terms of the Apache 2.0 License for FINTRAC LTD’s Custom Code, but third-party components, including TRAC D.A.P., remain subject to their original licenses. By using or distributing the Image, you agree to comply with all applicable terms and conditions set forth herein.

⁠1 LICENSE STRUCTURE

⁠1.1 License for the Image as a Whole

The Image is provided under the Apache License, Version 2.0, with additional restrictions imposed by the Commons Clause, as well as the licenses of the third-party components included in the Image. This License governs the use, modification, and distribution of the Image as a whole, with specific terms for FINTRAC LTD’s Custom Code and third-party components.

⁠1.2 Custom Code (FINTRAC LTD)

Custom Code developed by FINTRAC LTD is licensed under the Apache 2.0 License, subject to the Commons Clause, which restricts certain commercial uses of this Custom Code, including selling, reselling, or incorporating it into a paid product or service. The Commons Clause only applies to the Custom Code developed by FINTRAC LTD and not to third-party components.

⁠1.3 Third-Party Components and Licenses

The Image includes third-party software components, each licensed separately under their respective open-source licenses, including GNU General Public License (GPL), MIT, BSD, and others. These third-party components are separately licensed and remain subject to their original open-source licenses, which are not modified by the License for the Custom Code. Users must comply with each third-party component's respective license terms. Some of these third-party licenses, such as the GPL, impose additional obligations, including copyleft provisions if these components are modified or redistributed.

⁠1.4 Conflicts and Precedence

The Commons Clause modifies the rights granted under the Apache 2.0 License only for the Custom Code developed by FINTRAC LTD. Third-party software components are governed solely by their respective licenses. In the event of a conflict between a third-party license and this License (which applies to the Custom Code), the third-party license will take precedence.

⁠2 PERMITTED USES

Under this License, you may:

• Use, modify, and redistribute the Custom Code licensed under the Apache 2.0 License, subject to the restrictions imposed by the Commons Clause.
• Deploy the Image in non-commercial applications, such as for research, educational use, or internal business use.
• Use third-party software components in accordance with their respective open-source licenses (e.g., GPL, MIT, BSD).

However, you may NOT:

• Sell or resell the Custom Code covered by the Commons Clause.
• Provide paid hosting, consulting, or support services that derive substantial value from the Custom Code in the Image.
• Modify and distribute GPL-licensed components without complying with the obligations of the GPL, including making the modified source code available.

⁠3 DISCLAIMER

The Image is provided ‘as is,’ without any warranties of any kind, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement, or guarantees of compatibility or security. The authors of this Image disclaim all liability for any direct, indirect, incidental, or consequential damages, or any legal claims arising from the use, modification, or distribution of the Image. Users assume full responsibility for their use of the Image. It is recommended that users seek legal counsel to ensure compliance with all licensing requirements.

⁠4 COMMERCIAL RESTRICTIONS (COMMONS CLAUSE)

The following Commons Clause applies to the Custom Code contained in this Image and does not apply to third-party components, which are governed by their respective open-source licenses:

• The Software is provided to you by the Licensor under the License, subject to the following condition.

• Without limiting other conditions in the License, the grant of rights under the License will not include, and the License does not grant to you, the right to Sell the Software.

• For purposes of the foregoing, “Sell” means practicing any or all of the rights granted to you under the License to provide to third parties, for a fee or other consideration (including without limitation fees for hosting or consulting / support services related to the Software), a product or service whose value derives, entirely or substantially, from the functionality of the Software. Any license notice or attribution required by the License must also include this Commons Clause License Condition notice.

⁠5 THIRD-PARTY COMPONENTS AND LICENSES

This Image contains software components developed by FINTRAC LTD and third parties which are published under their respective open-source licenses. The key components and their licenses include:

• Linux base image and system packages – Licensed under various licenses, including the GNU General Public License (GPL).
• Java Open JDK – Licensed under the GNU General Public License (GPL) with the Classpath Exception.
• Python – Licensed under the Python Software Foundation License Agreement.
• Java libraries – Licensed under various permissive licenses, including Apache, MIT, and BSD.
• Python libraries – Licensed under various permissive licenses, including Apache, MIT, and BSD.
• TRAC D.A.P. – Licensed under the Apache License, Version 2.0.

By using this Image, you acknowledge the following:

• The licenses for the individual components remain in effect and are not modified, superseded, or otherwise altered by the License.

• It is your responsibility to review and comply with the terms of each component’s respective license, especially for components licensed under the GNU General Public License (GPL) or other licenses with specific requirements.

⁠Note on GPL-Licensed Components

This Image includes GPL-licensed components (e.g., Linux base image and Java Open JDK). Redistribution or modification of GPL-licensed components requires compliance with the GPL's copyleft obligations, which may include providing access to modified source code under the same license. It is the user's responsibility to ensure compliance with these obligations when using or distributing this Image or any derivative works.
